Privacy statement

BÜTER Hydraulics Beheer B.V. and its affiliates (hereinafter jointly referred to as ‘BÜTER’ or ‘we’) have prepared this privacy statement because we believe that data protection is essential. 

This privacy statement contains information about how BÜTER processes personal data in the context of its business operations. One of the ways we do this is through our websites: www.bueter.com and www.bueter-hubtische.de. This privacy statement contains, among other things, information on the purposes for which we process personal data and how we process that data. It also explains what your rights are with regard to the processing of your personal data. 

It is good to know that, for processing your data, we are the so-called ‘controller’ within the meaning of the General Data Protection Regulation (‘GDPR’). We therefore process your data in accordance with applicable privacy legislation, including the GDPR. 

Please read this privacy statement carefully so that you understand how we process your personal data. If you have any questions after reading through the privacy statement or would like to contact us, please do so using the contact details stated at the end of this privacy statement.

A. Definitions
BÜTER's privacy statement is based on the terms set out in the General Data Protection Regulation (GDPR). The intention is that this privacy statement is easy to read and understand for visitors to our website. To ensure this, we explain some of the terms used. We use the following terms in this privacy statement:

(a) Personal data
‘Personal data’ refers to any kind of information about an identified or identifiable natural person (hereinafter referred to as the ‘data subject’). An identifiable natural person is someone who can be identified, directly or indirectly, in particular by an identifier such as a name, an identification number, location information or an online identifier.

(b) Data subject
‘Data subject’ refers to any identified or identifiable natural person whose personal data is processed by controllers.

(c) Processing
‘Processing’ is any operation or set of operations involving personal data or a set of personal data, whether or not carried out using automated processes, including the collection, recording, sorting, structuring, storage, updating, editing, retrieval, consultation and use of data.

(d) Controller
The controller is the natural or legal person, authority, agency or other body that, alone or jointly with others, determines the purposes and means of processing personal data. 

(e) Processor
The processor is a natural or legal person, authority, agency or other body that processes personal data on behalf of the controller.

(f) Third party
A third party is a natural or legal person, authority, agency or body other than the data subject, the controller, the processor and the persons authorised to process personal data under the direct authority of the controller or the processor.

B. What personal data do we process?
We process personal data only to the extent necessary. For example, to answer your questions, to conduct our business, to keep proper records as well as to comply with legal requirements. 

We process the personal data of our former, current as well as prospective customers, suppliers and other business associates, the contact persons working for them, as well as job applicants. We get your data (i) directly from you; (ii) from third parties (for instance, customers and supply chain partners); or (iii) from public sources, such as the chamber of commerce. 

Below is an overview of the personal data we may process:
basic information such as your first and last name, title, gender;
contact details such as your e-mail address, postal address, telephone number, the company you work for, if applicable, and your job;
financial information, such as your IBAN/bank account number;
personal data you give us when you apply for a job with us, such as an application letter, CV, date of birth, and details regarding your education and career;
any other personal data that we are given by you or about you and that we use for the purposes set out below. 

As indicated, we process personal data only to the extent necessary. So we do not always process all the above information. It depends on the relationship you have with us, the service involved and/or the consent you have given us.

C. For what purposes do we process personal data? 
We process the above personal data for one or more of the following purposes (partly depending on our relationship with you):

Marketing and acquisition purposes
We may process your personal data for sending newsletters and other marketing communications that may be relevant to you. 

Implementing an agreement 
We process your data to the extent necessary in the context of the services we provide. 

Meeting legal obligations
We process your data to the extent necessary to comply with legal obligations. Depending on our relationship with you, the law requires us to provide information to the tax authorities, public registers and regulators, for example.

Job applications and recruitment
We process the data you share with us when you apply for a job with us (via e-mail/or the post) or that we receive through recruiters to contact you for the purpose of our application process and to process your application. If you do not apply for a specific vacancy (i.e. if you send an open application letter), we will use your data for all vacancies at the time of application that meet your requirements or your stated wishes.

Access control and camera surveillance
For security purposes, we keep track of those entering our premises. There is also camera surveillance in and around our premises. We use camera surveillance to protect the safety of employees and visitors, as well as to protect company property and vehicles on the premises. 

Use and improvement of our website
We process statistical data on visits to and the use of our website. We do this to tailor the content, layout and use of our website to your personal preferences. You can also contact us by e-mail or using the contact form. The personal data entered in the process is automatically stored. This data is stored to process your request or to contact you. 

Other processing 
We also process your data to handle any queries or complaints that may have been submitted using the contact form or via the website.

D. On what basis we process personal data
We process your personal data based on one or more of the following legal grounds:
to enter into or implement a contract with you;
to comply with legal obligations;
a legitimate interest;
your consent.

E. Sharing your personal data
In some cases, we share your personal data with third parties. Again, we will only do this to the extent that we believe it is necessary or if we are required to do so by law. Needless to say, we only share your data with trusted parties and ensure that the data is shared with due care. 
We may share your personal data with: 
government agencies such as the tax authorities;
BÜTER clients and customers;
service partners and other service providers such as banks, insurers, credit bureaus, accountants, tax advisers and other consultants;
external suppliers such as ICT service providers, hosting and cloud service providers and/or other suppliers to whom we outsource support services.

If the third party with whom your personal data is shared is considered a ‘processor’ within the meaning of the GDPR, we will enter into a data processing agreement with that third party. 

F. Transfer of personal data outside the European Union
If personal data is transferred to parties outside the European Economic Area (‘EEA’), we will ensure that this privacy statement and applicable privacy and other laws are always complied with. 

G. Retention periods
We only process and store data subjects’ personal data for the period necessary to achieve the purpose of storage or to the extent that this is subject to statutory retention periods. If the purpose of storage is no longer applicable or if a legal retention period expires, personal data will be routinely blocked or erased in accordance with legal provisions.

H. What rights do you have under the GDPR?
You have several rights on the grounds of the GDPR regarding the processing of your personal data. You have the following rights:
Right of access: you have the right to access the personal data we process about you. You are also entitled to access the purpose and duration of the processing.
Right to rectification: if we have recorded incorrect or incomplete data about you, you have the right to rectify it (or have it rectified). We will then update the data and may also pass this on to third parties who were given your data via us. 
Right to erasure: you have the right to request that we delete your personal data. You can request this if, for example, we no longer need your data for the purposes or if you have withdrawn consent. Always keep in mind that we are obliged to retain certain information. 
Right to restriction of processing: you have the right to temporarily stop the processing of your data, for example if you dispute the accuracy of your personal data or if you have objected to the processing and this request is still pending. 
Right to data portability: you have the right to get the personal data you have given to us in a digital file from us, provided the personal data has not already been erased.
Right to object: finally, you can object to the processing of your personal data if we process the data on the basis of a ‘legitimate interest’ or if you object to us sending newsletters to you.

Sometimes we cannot comply with your request. For example, because the processing of your personal data is required to fulfil our legal obligations, or because of other exceptions, for example the rights and freedoms of third parties or BÜTER’s legitimate interests. Should we be unable to comply with a particular request from you, we will let you know and will also state the reason. 

If the processing of your personal data is based on consent, you are entitled to withdraw that consent at any time. However, the processing of your personal data that has already taken place remains lawful because you had previously given your consent. 

There are in principle no costs associated with exercising the aforementioned rights. However, if it concerns clearly unfounded or – especially in the case of frequent repetition – excessive claims regarding the aforementioned rights, we may, in accordance with Article 12(5) of the GDPR, either
charge a reasonable fee, taking into account the administrative costs of providing the information or notification or of implementing the measure requested; or refuse to respond to the claim.
Finally, you also have the right to lodge a complaint with a supervisory authority. A list of all supervisory authorities in the EU is available on the website of the European Data Protection Board: edpb.europa.eu/about-edpb/board/members_en. I. Protection of your personal data
We take the protection of your personal data seriously and take appropriate security measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised modification. If you feel that your data is still not secure or there are indications of misuse, please get in touch using our contact details.

J. Cookies
We use cookies and/or similar technology on our website. A cookie is a small text file stored on the device (computer, tablet or smartphone) you use to visit our website. We use cookies to personalise content and advertisements, provide social media features and analyse website traffic. We only use functional, analytical and tracking cookies.

The functional cookies we use are necessary for the proper functioning of our website and ease of use. For example, they make sure the website works properly and remember preferences. 

We use analytical cookies to collect statistical data on the use of our website so that we can improve our services. We use analytical cookies to gain insights into your website activities so that we can analyse and improve the user experience of our services on an ongoing basis. For example, we use Google Analytics, a web analytics service provided by Google Ireland Ltd. ('Google'), Gordon House, Barrow Street, Dublin 4, Ireland. We have entered into a data processing agreement with Google for this purpose and fully comply with the strict requirements of the German data protection authorities when using Google Analytics. 

The information generated with Google Analytics is transmitted to a Google server, which may be located in the European Economic Area or in the United States. We use Google Analytics only with activated IP address anonymisation (‘IP anonymisation’). Any transfer of personal data to the United States is done on the basis of the EU-US Data Privacy Framework, for which Google LLC, which is based in the United States, is certified (https://www.dataprivacyframework.gov/s/participant-search/participant-detail?id=a2zt000000001L5AAI&status=Active). We use tracking cookies to collect information about visitors’ browsing behaviour so that we can offer tailored content and advertisements. This requires the visitor’s permission. 

Your browser allows you to disable the placement of cookies. However, this may prevent certain features of our website from working properly. 

K. Social media
We have an online presence (through a so-called ‘fan page') on Facebook, the social network, so that we can communicate with users there and inform them about us. Together with Meta Platforms Ireland Ltd (hereinafter ‘Meta’), we are responsible for collecting the personal data of those who visit our fan page. This personal data allows us to learn more about our fan page visitors and their interaction with our fan page. For more information, visit https://www.facebook.com/legal/terms/information_about_page_insights_data. We have made a special arrangement with Meta about this joint responsibility. You can view this arrangement at https://www.facebook.com/legal/terms/page_controller_addendum. However, Meta is solely responsible for the further processing of personal data. This applies in particular to the transfer of personal data to Meta Platforms, Inc. in the US. 
When using our fan page, personal data may also be processed outside the European Economic Area. Meta Platforms, Inc. is certified under the EU-US Data Privacy Framework (https://www.dataprivacyframework.gov/s/participant-search/participant-detail?id=a2zt0000000GnywAAC&status=Active).

L. MEETOVO
We use the software solution of MEETOVO Software GmbH, Robert-Koch-Straße 8, 21423 Winsen (Luhe), Germany, to process requests. If you send an application via the integrated form, the personal data you enter for the application (e-mail address, first and last name, mobile phone number or telephone number) will be forwarded to MEETOVO and stored on their servers and sent to us by e-mail. All other data entered is passed on for analysis purposes as you enter it, if you give your consent. MEETOVO operates in accordance with the legal requirements of Article 28 of the GDPR. M. Changes to this privacy statement
We may change this privacy statement from time to time. Changes will be published on our website. It is therefore prudent to read this privacy statement regularly to be aware of any changes. We will do our best to announce changes separately as well.
